Building a pool in Dubai without the right permits is not only illegal, but it also puts the owner of the land at risk. You can pay for the building of the pool, and you can pay for its removal. DDA is empowered to approve projects in DDA jurisdiction. Trakhees (a part of the Ports, Customs, and Free Zone Corporation) regulates development in the Jebel Ali Free Zone and port areas and in some other jurisdictions. TECOM, Dubai South, and other zone-specific authorities govern their respective areas. You’ll need to find out who has jurisdiction over your particular property before you start the permit process. COMMUNITY AUTHORITY AND HOA REQUIREMENTS
Many of Dubai’s villa communities are managed by homeowners’ associations (HOAs) or community management groups that are less directly supervised than the city’s main government body. These governing bodies often have specific regulations for pools, including location, distance from property lines, required fencing, wall materials, and permissible aesthetics. Usually you need to get a No Objection Certificate (NOC) from the community management body before you send your application to the main government authority. This NOC states that the proposed pool is as per the community rules and that the community authority has no issues with the construction going ahead. WHAT THE PERMIT APPLICATION INVOLVES
In Dubai, you normally need a set of documents to obtain a building permit for a pool. This includes a site plan showing the location of the pool within the property, architectural plans showing the design and dimensions of the pool, structural engineering plans showing the construction of the pool shell and foundation, and occasionally a geotechnical report for the site. And finally, a drainage plan that explains how the pool water will be handled for backwashing and surcharging, too. Papers must be prepared by professionals with the right credentials and signed by a civil or structural engineer registered in the UAE. The application is sent to the right authority. They look over the paperwork, ask for more information or changes, and then either issue (or deny) the building permit. The time it takes for a permit to be approved depends on many factors, such as the complexity of the application and the workload of the authority. Occasionally, the Dubai Municipality accepts simple applications in two to three weeks. More complex applications, or those that require approval from more than one body, can take six weeks or more.
